Economic Freedom Fighters (EFF) leader Julius Malema criticized the State’s prosecution during his firearm discharge trial in the East London Magistrate’s Court on Thursday, labeling it an abuse of power.

Malema faces charges related to allegedly firing a live weapon on stage at an EFF rally in Mdantsane in 2018. Security official Adriaan Snyman is also charged, with the State alleging he provided Malema with the weapon.

Malema claimed it was a toy gun and part of an “act,” but State advocate Joel Cesar challenged this assertion on Thursday.

“An incompetent, incoherent, inferior prosecution is what you’re trying to prove here – an abuse of power. You’ll not win with me,” Malema countered.

“This act can be performed anywhere. I can even go perform it on the grandstand if you wish. Anywhere. There’s no prescription by the law.”

The case is set to return to court in November for further arguments.
